Lawyer Irina Sivakova spoke about a court case in which a man refused to repay a debt of 135 thousand rubles to a microfinance organization (MFO). The MFO filed a lawsuit, but the man managed to prove that he did not sign a loan agreement to receive money. The MFO stated that the loan agreement was concluded online, the man went through the registration procedure and confirmed the code sent via SMS. However, the MFO was unable to prove that the man received the funds. In response to the court’s request about how the money was transferred, the MFO did not provide any information. As a result, the court refused to collect the debt from the MFO. This precedent established a new rule: if the MFO cannot prove that the borrower received the money, then it will be impossible to collect the funds. It is important for Russians applying for loans to take this precedent into account.
